Terms of Service

These Terms of Service govern your access to and use of QuoterIQ. By creating an account or using the Service, you agree to them. Please read them carefully before using the Platform.
1. Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you and QuoterIQ ("QuoterIQ," "we," "us," or "our") governing your access to and use of the QuoterIQ website and platform (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an agency or organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. Who May Use the Service
The Service is intended for use by licensed insurance professionals and their authorized staff. You represent that you hold the licenses and appointments required to conduct the insurance activities you perform using the Service, and that your use complies with all laws and regulations applicable to your business, including state insurance and licensing requirements.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information, to keep it current, and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that we reasonably believe are being used in violation of these Terms or applicable law.
4. The Service; Quotes Are Estimates
QuoterIQ provides tools to quote life insurance products, screen carrier eligibility, manage leads, and communicate with clients. Quotes, eligibility results, and underwriting guidance are estimates and informational aids for comparison purposes only. They are not offers of insurance, binding quotes, or guarantees of coverage, premium, rate class, or approval. Actual terms are set solely by the issuing carrier following its own underwriting. You are responsible for verifying information with the carrier before relying on it with a client.
The Service is not legal, financial, tax, or compliance advice. You remain solely responsible for your recommendations to and dealings with your clients.
5. Your Responsibilities Regarding Client Data
You are responsible for the information you enter into the Service, including information about your clients. You represent that you have collected such information lawfully and have all necessary consents and authority to enter it, to use the communications features (including any required consent to record calls or send messages under applicable law), and to process it through the Service. You agree to handle client information in compliance with applicable privacy and consumer-protection laws.
6. Acceptable Use
You agree not to:
- use the Service for any unlawful, fraudulent, or deceptive purpose;
- use the communications features to send unlawful, harassing, or non-consented messages or calls, or in violation of telemarketing, anti-spam, or do-not-call rules;
- use enrichment or third-party data for any purpose governed by the Fair Credit Reporting Act (FCRA) or to make eligibility decisions;
- resell, redistribute, or scrape pricing or carrier data obtained through the Service, or use it outside the Service in violation of our or our data providers' license terms;
- attempt to access accounts, data, or systems you are not authorized to access;
- reverse engineer, copy, or create derivative works of the Service except as permitted by law; or
- interfere with or disrupt the integrity or performance of the Service.
7. Third-Party Services and Integrations
The Service relies on third-party providers (such as pricing data, telephony, transcription, AI processing, authentication, and hosting) and may offer optional integrations you choose to connect. Your use of optional integrations may also be subject to the third party's terms. We are not responsible for third-party services, and their availability may change.
8. Subscriptions, Fees, and Billing
Access to paid features requires a subscription. Fees, billing frequency, and plan details are presented at sign-up or in your account. Unless stated otherwise, fees are billed in advance, are non-refundable except as required by law, and recur until cancelled. We may change pricing on a prospective basis with reasonable notice. You authorize us and our payment processor to charge your payment method for applicable fees and taxes.
9. Intellectual Property
The Service, including its software, design, and our curated carrier intelligence, is owned by QuoterIQ or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your subscription. You retain ownership of the data you enter; you grant us the rights needed to host and process it to provide the Service.
10. Confidentiality and Data Protection
We handle the data in the Service in accordance with our Privacy Policy and maintain safeguards aligned with the Gramm-Leach-Bliley Act (GLBA). Our Privacy Policy is incorporated into these Terms by reference.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT QUOTES, ELIGIBILITY RESULTS, OR DATA WILL BE ACCURATE OR COMPLETE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, QUOTERIQ AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless QuoterIQ from claims, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your data, your dealings with your clients, or your breach of these Terms or of applicable law.
14. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or its users. On termination, your right to use the Service ends. We will make your data available for export for a reasonable period where practicable, after which it may be deleted subject to legal retention requirements.
15. Changes to the Service and These Terms
We may modify the Service and may update these Terms from time to time. If we make material changes, we will provide reasonable notice. Your continued use after changes take effect constitutes acceptance.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over disputes, and you consent to their jurisdiction and venue, except where applicable law provides otherwise.
